The Boland Survey Report Terms of Use Agreement 

By logging into this database, you agree that all the information resulting from the Boland Survey (“Results”) is proprietary to the Calgary Chamber of Voluntary Organizations (“CCVO”). CCVO authorizes you (“Subscribing Organization”) to view, download, or print the information, including charts and reports, subject to the following terms and conditions: 

1. You may only do so for the internal, non-commercial use of the Subscribing Organization. 
2. The Results may not be reproduced, published, or distributed in any form expect as required for the internal use of the Subscribing Organization. 
3. Respecting principles of fair dealing, information or data from the Results may be referenced in other publications but such references must cite CCVO and the source Boland Survey. 
4. Downloading or using any of the Results for commercial purposes is prohibited. 
5. You agree and acknowledge that CCVO does not verify or confirm the accuracy of any data provided to it for generating Results, nor does it have any obligation to do so. Accordingly, the Results are provided on an “as is” basis only with no warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, merchantability, or fitness for a particular purpose.  
6. In no event will CCVO be liable to the Subscribing Organization for any loss of use, revenue, or profit or loss of data or for any consequential, incidental, indirect, special, aggravated, exemplary, or punitive damages howsoever arising out the use of the Results by the Subscribing Organization.  
7. In no event shall the aggregate liability of CCVO arising out of or related to this agreement, whether arising out of or related to breach of contract, tort (including negligence), or otherwise, exceed the amounts paid by the Subscribing Organization to CCVO for the services and access to Results provided under this agreement. 
8. The participant shall defend, indemnify, and hold CCVO harmless from and against any and all liability, losses, expenses, legal fees, or claims for injury or damages arising out of the performance of this agreement.  
9.  The subscription to access and download the reports is valid for the calendar year in which it was purchased. 

The Boland Survey Participation Agreement 

The Calgary Chamber of Voluntary Organizations (CCVO) collects, analyzes, synthesizes, and summarizes data collected from nonprofit organizations and provides the results in aggregate form via our database platform. Subscribers to the database platform submit data prior to accessing these results. By submitting your data, you agree to the following terms and conditions: 

1. To submit accurate and complete data to CCVO for all positions, human resource practices, and benefits relevant to the Boland Survey within the agreed timeframe. 
2. All rights, title, and interest in all intellectual property rights in or associated with any CCVO results are the exclusive property of CCVO and any unauthorized reproduction or distribution is prohibited. CCVO results are intended for your internal purposes only. You shall ensure that your employees, contractors, consultants, and others with access to the Boland Survey reports will abide by this non-disclosure requirement. 
3. CCVO may share original data and Results at its discretion for research and commercial purposes without identifying information and while maintaining the confidentiality of participants.  
4. To the extent that your data may constitute personal information, you represent and warrant that all requirements associated with the protection of personal information, under applicable law, have been compiled prior to the submission of data to CCVO. 
5. CCVO may represent your organization/company as a participant for marketing and reporting purposes, including on the participant list in reports and on the Boland Survey website.
